These terms and conditions apply
to all contracts between you and us.
The Kardex Direct site is intended and designed solely for Business to Business users not private individuals and/or consumers.
Definitions
“We”, “us, “our”, means
Kardex Direct- a division of Kardex Systems (UK) Limited.
“You”, “your” means the person/company ordering products under these terms and
conditions.
“Working days” means all days other than Saturdays, Sundays, and Public Holidays.
“Product” means the product or products you have ordered from us.
How to place your
orders
Products and availability
It is possible that occasionally
stock items may be temporarily out of stock. In such cases, we will try to find
an alternative and will keep you informed about the progress of your order.
We will make every reasonable effort to deliver the products you have ordered
within three days of the date of your order. If this is not possible, we will
notify you and at your option agree a different delivery period or provide a
substitute product of equivalent value. Alternatively, you may cancel your order
in which case, if your payment card has been debited, we will refund you the
purchase price.
On some occasions, we are required by the card issuer to perform additional
security checks on the payment card. This can delay the order until the card
has been authorised.
The delivery times given are approximate and delays can sometimes occur. You
will receive an email as soon as your order is dispatched. You will become the
owner of the products you have ordered when the products have been delivered
to you
Price
& delivery
Prices shown
on this site exclude VAT, this tax will be applied to the product under UK VAT
law. Delivery charge is £9.75 up to an order value of £100, excluding
VAT, over £100 there is no delivery charge. Please note that the minimum order value you can place on the site is £50 excluding VAT
The
Contract Between Us
After you
have confirmed your order we will send an email to you summarising each order
you have placed.
When your order is processed we will debit your payment card with the total
cost of your order.
Contracts formed between Kardex Direct –a division of Kardex Systems (UK)
Limited- and users as a result of using this site shall be governed in all respects
by English law and all such users hereby submit to the non-exclusive jurisdiction
of the English courts.
There is no contract between you and Kardex Direct for the sale of products
by us to you until your credit/debit card has been charged. This will be deemed
to be our acceptance of your offer and to have been effectively communicated
to you. This is to be interpreted and enforced with the laws of England, in
its entirety and will be subject to the jurisdiction of the English courts.
This disclaimer does not affect your statutory rights as a consumer.
In some rare instances we may decline to deliver to PO addresses. We will contact
you if we consider the PO address to be a problem.
Payment Details
We accept payment by Visa,
MasterCard, Switch and Delta. All product prices and delivery charges are shown
in UK pounds sterling. Your payment card company will perform any currency conversion.
Your card will only be charged upon dispatch of the items in your order. Your
card will not be debited for items in your order which have not been dispatched.

Your Cancellation
Rights
Should you wish to cancel
an orders, contact our customer services team directly on 01992 566222 before
they are invoiced and dispatched. Requests for cancellations sent via email
may not be actioned for 48 hours in extremely busy periods, which may result
in the order being dispatched.
If you cancel your order
within seven
working days after the date of delivery, you must return the unwanted products
to us unused and in their original packaging at your risk and at your cost within
fourteen days of delivery. Provided you return the unwanted products unused
and in the original packaging within fourteen
days of delivery, we will credit your payment card with the cost of the unwanted
product and our delivery charges within thirty
days of the date of cancellation. This cancellation will be subject to a 30%
restocking charge.
Return of Faulty,
Incorrect or Sub-standard Products
If the products delivered
are faulty, incorrect or damaged in transit to you, we will refund you the cost
of the products and any delivery charges. Any such products must be returned
to us within seven days of delivery or your rights to return the products are
waived and void.
Pricing Errors
Although we make every
effort to ensure the prices on the website are correct, mistakes may sometimes
be made. If we discover a mistake in the price of the products you have ordered,
we will tell you and give you the option of either reconfirming your order at
the correct price or cancelling your order.

Protection/Privacy Policy
Kardex Direct is committed
to protecting your privacy and we will only use the information that we collect
about you lawfully and in accordance with the Data Protection Act 1998. The
reasons why it is necessary for us to collect information about you are as follows:

We may use your details to keep you up to date with Kardex products and promotions only.
We will not pass on your details to any third parties.Below is a list of the

In accordance with our
internal procedures for monitoring traffic to our websites, we may use technology
to analyse visitor traffic to our site, this will involve the use of "cookies"
which would be stored on your computer. Cookies containing personally identifiable information e.g. name, address, etc. will only be stored on your computer you have requested the option to do so. This means that you will not have to enter the same details in everytime you visit Kardex Direct and your details will automatically
appear on screen. Your browser will give you the option to restrict, disable, or delete cookies (see the "help"file in your
browser)
We never store credit/debit
card details
These will have to be entered
by you each time you place an order.

Payment Card Security Policy
Kardex Direct uses WorldPay
for all credit/debit card transactions and below is a copy of the Security Statement

and the retailer during an online transaction. In reality an online transaction
is probably more secure than a card transaction in a shop or conducted over
the telephone or by fax, as the information transmitted online is highly encrypted
using complicated logarithm combinations.
The WorldPay payment system uses a combination of both established and innovative
techniques to ensure the security and integrity of all sensitive data. Furthermore,
our public web servers are certified by Thawte, a public Certificate Authority,
ensuring that both the shopper and retailer can have confidence that nobody
can impersonate WorldPay to obtain confidential information.
Transaction Encryption
The transfer of the purchase details from the retailers site to Worldpay are
encapsulated using our own encrypted and digitally-signed protocol. This uses
a combination of standard methods such as PGP, RSA and MD5 to ensure that the
information passed is secure and tamper-proof.
Data Storage
Data storage on WorldPay systems, and the communication between WorldPay and
the worldwide banking networks, is regularly audited by the banking authorities
to ensure a secure transaction environment. We also ensure that we stay up-to-date
with the latest versions of any third-party code we use, and continually review
our own proprietary code.“
Limitation
of Liability
We will not be liable to
you:- For any loss of profit, administrative inconvenience, disappointment,
or indirect or consequential loss or damage arising out of any problem in relation
to the products you ordered which was not within our reasonable contemplation
as a probable result of a breach of contract on our part at the time that our
contract with you was concluded.
Where performance of any
obligations to you is prevented, frustrated or impeded by any circumstance or
caused beyond our reasonable control.
Severability
If any part of these terms
and conditions is found to be unenforceable as a matter of law, the enforceability
of any other part of these terms and conditions will not be affected.
Governing Law
These terms and conditions
and any contract between us shall be governed by and interpreted in accordance
with English Law and the English Courts shall have jurisdiction over any disputes
between us.
Statutory Rights
These terms and conditions
are in addition to your statutory rights as a consumer which remain unaffected.

Upon Receipt Of
An Order
Seller Liability
The seller does not accept
liability for shortages in quantities delivered unless the buyer notifies the
seller of any claim of short delivery of the goods within two working days of
delivery. In such circumstances the seller’s liability shall be restricted
to making good the shortfall.

Returns
By post in accordance with the following procedure:- Repackage the products
securely within their original packaging and send the products together with
a copy of the original dispatch note to:

by post are made at your risk. We recommend that you use an insured registered
mail service as returns not received by us cannot be credited to you. Your return
delivery charges will be refunded by us if the return is made in accordance
with the conditions mentioned above. Refunds will be credited to your payment
card. Refunds will not be paid in cash.
